KODING CARAVAN MOBILE APPLICATION

Welcome to Koding Caravan. Please read these Terms and Conditions carefully before using our mobile application. These Terms govern your access to and use of the Koding Caravan application available on the Google Play Store and the Apple App Store.
By downloading, installing, accessing, or using the Koding Caravan mobile application ("App"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the App. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Koding Caravan ("Company," "we," "us," or "our").
We reserve the right to modify or update these Terms at any time without prior notice. Continued use of the App following any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
You must be at least 13 years of age to use the App. If you are under 18, you must have parental or legal guardian consent to use the App. By using the App, you represent and warrant that you meet the eligibility requirements and have the legal capacity to enter into these Terms.
Certain features of the App may require you to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
You must notify us immediately of any unauthorized use of your account or any other security breach. We shall not be liable for any loss or damage arising from your failure to safeguard your account credentials.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a compatible mobile device that you own or control, solely for your personal, non-commercial purposes.

The App may allow you to submit, post, upload, or share content, including but not limited to code, text, images, and other materials ("User Content"). You retain ownership of your User Content; however, by submitting User Content through the App, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, distribute, and display your User Content in connection with operating and improving the App.
You represent and warrant that you own or have the necessary rights and permissions to submit your User Content and that your User Content does not violate any third-party rights or applicable laws. We reserve the right to remove any User Content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.
All intellectual property rights in and to the App, including but not limited to its design, graphics, text, software, algorithms, trademarks, logos, and other content (excluding User Content), are owned by or licensed to Koding Caravan and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in such intellectual property except as expressly set forth herein.
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, store, and share your personal information. By using the App, you consent to the data practices described in the Privacy Policy. We are committed to protecting your privacy and complying with applicable data protection laws and regulations.
We may collect certain data automatically, including device information, usage statistics, crash reports, and analytics data, to improve the App and user experience. Such data may be processed in accordance with our Privacy Policy.
The App may offer in-app purchases, subscriptions, or premium features ("Paid Services"). All Paid Services are subject to the payment terms presented at the time of purchase. Payments are processed through the applicable app store (Google Play Store or Apple App Store), and you agree to abide by their respective terms of service.
Subscriptions will automatically renew unless canceled before the end of the current billing cycle. Refund eligibility is subject to the refund policies of the applicable app store. We reserve the right to change pricing for Paid Services at any time, with notice provided to existing subscribers.
The App may contain links to or integrations with third-party websites, services, or content that are not owned or controlled by Koding Caravan. We are not responsible for the content, privacy practices, or terms of use of any third-party services. Your interactions with third-party services are solely between you and the third party, and you access them at your own risk.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KODING CARAVAN, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, REGARDLESS OF THE THEORY OF LIABILITY.
Our total aggregate liability to you for all claims arising out of or relating to the App shall not exceed the amount you paid to us, if any, in the twelve (12) months preceding the event giving rise to the liability.
You agree to indemnify, defend, and hold harmless Koding Caravan and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the App; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.
We may suspend or terminate your access to the App at any time, with or without cause and with or without notice, at our sole discretion. Upon termination, your right to use the App will immediately cease, and you must delete all copies of the App from your devices.
All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Koding Caravan is established, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms shall be resolved through good-faith negotiation. If the dispute cannot be resolved amicably, it shall be submitted to binding arbitration in accordance with the rules of the applicable arbitration authority in the governing jurisdiction.
You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action, class arbitration, or any other representative proceeding.
You acknowledge that these Terms are between you and Koding Caravan only, and not with Apple Inc. ("Apple") or Google LLC ("Google"). Apple and Google have no obligation to furnish any maintenance or support services with respect to the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple or Google, and they may refund the purchase price (if any) of the App. To the maximum extent permitted by applicable law, Apple and Google have no other warranty obligation with respect to the App.
Apple and Google are not responsible for addressing any claims by you or any third party relating to the App or your possession and use of the App. Apple and Google are third-party beneficiaries of these Terms, and upon your acceptance, Apple and Google will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
When using the App, you agree not to:
We may, from time to time, issue updates, patches, or new versions of the App. Such updates may be required for continued use and may be installed automatically depending on your device settings. We reserve the right to modify, suspend, or discontinue any feature or functionality of the App at any time without prior notice or liability.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Koding Caravan with respect to the use of the App and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and the Company.
